My 16 month old son might need surgery to remove a cyst?

my son was born with a lump on the top of his head where the soft spot is. his first doctor said it was fine. we had xrays done. they said it would be gonje by the time he turned 1 yr old. my son is now 16 months old. the bump is still there! i started taking him to a new doctor and they told me last night at the appoinment that it might be a cyst and have to have surgery to be removed. this could have all been done 12 months ago in my opinion! now at 16 months he might have to have surgery. do you think i could sue his old doctor for mis diagnosing him? if so where do i start?

There is no way you would win..It did not cause permanent damage..That is what the courts would look at...My son had a cranio condition that his doc missed..It was not until I insisted on seeing a neurologist that something got done about it..He too needed surgery...But, the damage was already there, they did not cause it, and they are human..They had never heard of my son's condition..How can I sue over a human error when it did nothing to worsen the condition? That's my .02








Okay..Let's talk damage...My son inhaled a sunflower seed..I took him to the ER and told them that..They listened, told me he sounded good, and sent me home.Did they do an xray? Nope.....A few days later, he had gotten so much worse, I took him to another doc..At this point, his lung was collapsed, and he had pneumonia..Tell me I could not have sued this doc? He almost killed my son because he would not listen to me..Did I sue?? No..But, I did let his insurance company pay for EVERYTHING! This is life threathening...A cyst is just that...Yes, it could have burst..Yes, it would have been an owie...But, it would probably not have killed him...I am glad you are taking your anger out somewhere...Just make sure it's not misdirected.,
Reply:if this cyst hasn't caused your son any harm there is no case for you to sue them with. His old doc didn't do a good, thorough job but he didn't harm your son. And, I wouldn't be sueing anyway. Too many people sue for a little extra money just because someone made a mistake. Imagine if you were the one in his shoes. There is always that chance that you could make that mistake too because of never seeing it before. Doctors see new things everyday and don't always know what to do.

sometimes things are not what they appear. maybe the dr. didn't want to rush your child into unnessary surgery or tests.

Reply:Unless it posed some health problem that the first doctor overlooked...I doubt it. One thing that might put your mind at ease is the fact that kids seem to bounce back much faster than adults do from this type of situation. Where an adult would be laid up in bed for weeks....your son will probably be up and raring to go after just a few days. Nothing ever keeps them down for long. And even at 16 months, this experience is going to fade and be no more than a dim memory later in life.

one of my children had it too the doctors waited until she was 18 months old


hers was on the right side of her head( she was also paralyzed on the right side) they had to wait until she was strong enough the with stand the anesthesia


the only reason she was paralyzed was because the position of the cyst caused it to press slightly on the nerves


shes fine now.


most times cyst will go away on there own

really would you have prefered to see your baby under go elective surgery as a new born??????

also get another opinion


you've had two with different opinions get a third a decide from there.
Reply:I woudn't want to be the doctor who went through many years of school and work, to become a doctor to be able to save people who came to me, only to be sued by them as soon as they saw an open window to do so.





All this sueing hurts all of us in the long run when we wipe out hospitals and doctors and one day people just find a profession without the long hours, constant stress and sueing. Perhaps he did misdiagnos your son, but is it really something you need to sue for? There are other things to do and places to make reports if you want someone to be aware. You can also tell the doctor how you feel.





My son was born 3 months early. I went over and over to my doctor that something wasn't right and I was bleeding and leaking my water. All he ever did if anything at all was feel my uterous and say I ws still pregnant. I could have sued and I'm sure won a settlement, my son still has breathing problems due to his lungs not being developed and had this doctor examined me more and went by my symtoms he would of seen I had placenta previa. Others were sueing the doctor so I put my focus on my son.





A few years ago, my oldest son was badly hurt in a football game. I realized it first by the way he looked. I couldnt get anyone to listen to me. He ended up being life flighted that night. He had bleeding on his brain and a pretty good concusion. He lost vision and responsiveness before it was over. The sports trainer didn't realize he was as hurt as he was although I could see he was. I had to take him to the hospital ER myself. That trainer was reemed up and down not long after, but I didn't sue. I know my son got worse before I got to the hospital even though I don't think the trainer took it serious enough. I bet he does the next time. I could tell by his face at the ER he really didnt realize and it scared him pretty good when he saw my son at that point and knew he had been wrong. My son spent 3 days in a trauma unit but is fine now and I am happy for that.





Where you start is making sure its just cause and a suitable thing to solve your issue. Check this doctors history, does he often make mistakes?? You also had opportunity to take him elsewhere for a second opinion months ago. It may be alot of mumbo jumbo and more money out than in going this route. Sueing isn't always the best or right answer, it just seems to be the most common these days.
